Rust (com.rustfitness.app) — Effective / Last updated: August 2026
These Terms of Service ("Terms") are a legal agreement between you and Heath Shepard, an individual doing business as Rust ("Rust," "we," "us," "our") — Rust is not currently operated through a separate company or LLC. They govern your use of the Rust mobile application and related services (the "App"). By creating an account or using the App, you agree to these Terms. If you don't agree, don't use the App.
You must be at least 13 years old to use Rust. If you are under 18, you may only use Rust with the involvement and consent of a parent or legal guardian, and that parent or guardian is responsible for any subscription purchased. Rust is not directed at children under 13, and we do not knowingly allow anyone under 13 to create an account.
You're responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity under your account. Tell us right away if you believe your account has been compromised.
Rust, including its AI coach feature, does not provide medical, health, nutrition-therapy, or professional advice of any kind, and is not a substitute for consultation with a physician, physical therapist, registered dietitian, or other qualified healthcare provider.
The AI coach is an automated feature that generates training suggestions based on patterns in general fitness knowledge and the data you provide. It does not diagnose medical conditions, does not recommend medications or supplement dosages, and does not provide individualized medical nutrition therapy. Any general injury-caution guidance it gives (e.g., suggesting you see a doctor, or swapping an exercise for a sore joint) is not medical advice and should not be relied on as such.
Talk to a doctor before starting any new exercise or nutrition program, especially if you have any medical condition, are pregnant, are recovering from injury or surgery, or take medication. If you experience pain, dizziness, chest pain, shortness of breath, or any concerning symptom during a workout, stop immediately and seek medical attention. You use Rust, and act on anything Rust or its AI coach tells you, entirely at your own risk.
If you connect Apple Health (HealthKit) or Google Health Connect, Rust reads a limited set of data (steps, latest heart rate, active calories) from whatever your phone's health store already has — including data synced there by Garmin, Apple Watch, or other wearables you've connected at the OS level. Rust does not verify the accuracy of that third-party data and is not responsible for errors, gaps, or delays in it. See our Privacy Policy for how this data is handled.
If you use Feed, Challenges, or other social features, you agree not to post anything unlawful, harassing, abusive, defamatory, or that infringes someone else's rights, and not to impersonate another person. Content you post is visible to other users who follow you or share a challenge with you. We may remove content or suspend accounts that violate this section.
You agree not to: reverse-engineer or attempt to extract the App's source code except as permitted by law; interfere with or disrupt the App's operation or servers; use the App for any unlawful purpose; attempt to access another user's account or data without authorization; or use automated means (bots, scrapers) to access the App outside normal use.
The App, including its design, code, and content we create (excluding your own logged data and posts), is owned by us and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
Rust relies on third-party services to operate — including Supabase (data storage/ authentication), Anthropic (AI coach responses), ElevenLabs (voice synthesis), Stripe (payments), and Apple Health / Google Health Connect (optional wearable data). Your use of those integrations is also subject to those providers' own terms. We aren't responsible for outages, errors, or changes on their end that affect the App.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI COACH OUTPUT MAY CONTAIN INACCURACIES; YOU ARE RESPONSIBLE FOR EXERCISING YOUR OWN JUDGMENT BEFORE ACTING ON IT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW: RUST IS OPERATED BY AN INDIVIDUAL, NOT A CORPORATION OR LLC. NEITHER WE NOR ANY OF OUR SERVICE PROVIDERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $50. NOTHING IN THIS SECTION LIMITS LIABILITY WHERE THE LAW DOES NOT PERMIT IT TO BE LIMITED, INCLUDING FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE WHERE SUCH LIMITATION IS UNENFORCEABLE UNDER APPLICABLE LAW.
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the App, or content you post through the App's community features.
You may stop using the App and delete your account at any time (Settings → Delete Account). We may suspend or terminate your access if you violate these Terms, and we may discontinue the App or any feature at any time; where reasonably possible, we'll give notice first.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any dispute arising out of or relating to these Terms or the App will be resolved by binding individual arbitration under the rules of the American Arbitration Association, rather than in court, except that either party may bring an individual claim in small claims court. You and Rust each waive the right to a jury trial and to participate in a class action, class arbitration, or representative action. Any arbitration will take place in Bexar County, Texas, unless you and we agree otherwise. If any part of this arbitration provision is found unenforceable, the remainder still applies, and any claim excluded from arbitration will proceed in the state or federal courts located in Bexar County, Texas, and you consent to that venue and personal jurisdiction.
We may update these Terms as the App changes. We'll update the date at the top of this page, and for material changes we'll provide notice in the App. Continued use after changes take effect means you accept the updated Terms.
